2. Arbitration Agreement and Applicable LawYou and the operator of BasicEx agree that, pursuant to the first paragraph above, any dispute, claim, or controversy arising out of or in connection with these terms or the relationship between you and BasicEx (and/or the operator of BasicEx) as a user of BasicEx services, whether based on contract, tort, statute, fraud, misrepresentation, or any other legal theory, and whether the claim arises during or after the validity of these terms, shall be finally and exclusively resolved by mandatory, binding individual (not collective) arbitration. You and the operator of BasicEx further agree that the arbitrator shall have the exclusive authority to rule on its own jurisdiction, including but not limited to disputes over the existence, scope, or validity of the arbitration agreement, or any objection to the arbitrability of any claim or counterclaim. Arbitration is more informal than court litigation. There is no judge or jury in arbitration, and court review of an arbitration decision is limited. There may be more limited discovery compared to court proceedings. The arbitrator must comply with this agreement and may award the same damages and relief as a court, including, where applicable, attorney's fees, but the arbitrator may not award declaratory or injunctive relief favorable to any party other than the parties to the arbitration. The arbitration agreement specified in this clause remains effective after the termination of these terms. Arbitration Rules: At the time of submission of the arbitration notice, or when this Section 10 is modified in accordance with this Section 4, the arbitration shall follow the applicable arbitration rules of the Hong Kong International Arbitration Centre (HKIAC Rules) then in effect. The arbitration will be administered by the Hong Kong International Arbitration Centre (HKIAC). Unless otherwise agreed by the parties, only one arbitrator may be appointed under the HKIAC Rules. Any arbitration will be conducted in English. Regardless of the manner in which the arbitration is conducted, the arbitrator shall issue a reasoned written decision sufficient to explain the basic findings and conclusions on which the decision and award (if any) are based.

login.service.e3271xJudgment on any arbitration award may be entered by any court having jurisdiction over the party (or the party's property) submitting the claim. Time for Submission: Any arbitration against the operator of BasicEx must commence within one (1) year after the party asserting the claim first knows or reasonably should know of the act, omission, or default giving rise to the claim; for any claim not brought within this period, no remedy may be sought. This one-year limitation includes the internal dispute resolution process specified in the first paragraph of this Section. For any claim not brought within this period, no remedy may be sought. If applicable law prohibits a one-year statute of limitations for claims, any claim must be brought within the shortest time allowed by applicable law.login.service.968c2f

Procedure; Notice: After the dispute resolution period specified in the first paragraph above has expired, if either party wishes to apply for arbitration, it must submit a request to the HKIAC in accordance with the HKIAC Rules. If we require arbitration of your application, we will notify you by the email address or mailing address you provided. You agree that any notice sent to this email or mailing address shall be deemed effective for all purposes, including but not limited to determining whether delivery is adequate. Hearing Venue: Unless the parties agree otherwise, any personal arbitration hearing venue shall be in Hong Kong. Applicable Law: These terms (including this arbitration agreement) shall be governed by Hong Kong law and interpreted in accordance with Hong Kong law. Confidentiality: The parties agree to keep the arbitration confidential. The existence of arbitration, any non-public information provided during arbitration, and any documents, orders, or awards submitted in arbitration (collectively referred to as 'confidential information') shall not be disclosed to any non-arbitration party, except for the arbitration tribunal, HKIAC, the parties, their lawyers, experts, witnesses, accountants, and auditors, as well as any other individuals necessary for the conduct of arbitration. Despite the above provision, a party may still disclose confidential information if the disclosure is necessary to fulfill legal obligations, protect or enforce legal rights, or in good faith legal proceedings to enforce or challenge the award. This confidentiality provision remains effective after the termination of these terms and any arbitration initiated under these terms.

3. Waiver of Class ActionYou and BasicEx agree that any claim relating to these terms or the relationship between a user of BasicEx services and BasicEx shall be brought in the name of the individual as an arbitration claim against the other party, rather than as a plaintiff or member in a proposed class action or representative action. You and BasicEx further agree that, to the extent permitted by applicable law, you waive any right to bring, litigate, or arbitrate any claim in the manner of a collective, joint, representative, or private attorney general action. Without the consent of all parties, individual arbitrations may not be consolidated or merged into one arbitration.

4. AmendmentBasicEx reserves the right to update, modify, revise, suspend, or make any future changes to Section 10 regarding the arbitration agreement, but must comply with applicable law.
